By using the Elegant Chauffeur Service Inc., you signify your acceptance of these terms of use. If you do not agree with any of the terms of use below, please do not use our service. Elegant Chauffeur reserves the right, at any time, to modify, alter or update these terms of use. You agree to be bound by such modifications, alterations, or updates.

Reservations

We recommend that our clients reserve a car ahead of time (at no additional charge) to be guaranteed a car at the time of pick-up. We can provide you with a car at short notice by phone or online upon availability.

Modifications to Reservations

Modifications to reservations are typically regarded as creating new bookings. Therefore, the cancellation policy (as outlined in Ride Cancellation) applies to the originally scheduled ride. Elegant Chauffeur may initiate a compensation claim for the originally agreed-upon ride accordingly.

No-Shows

If you do not see your driver at a certain pick-up point do not leave before calling the dispatch office at (877) 435-2445 — we will direct you to your chauffeur. If you leave without calling you will be billed for the full price of the ride (or a no-show fee).

If we do not hear from you, the driver will wait up to 30 minutes at regular pickups and up to 60 minutes at inside airport pickups after the scheduled pickup time. We will then try to reach you by phone. If we do not get a response we will release the car and you will be billed for a no-show which is the full price of the ride plus any waiting time charges.

A "No Show" fee equal to the trip cost plus the applicable wait time fee will be charged when the passenger fails to arrive at the designated location. If you cannot locate your driver, please call (877) 435-2445 to avoid a "No Show" fee.

No-Show — Transfer Services

A ride is classified as a no-show if the client or guest fails to appear without prior cancellation within 30 minutes of the agreed pickup time at the specified pickup location. In the case of a no-show, the entire ride fare must be settled, and additional charges for waiting time do not apply.

For airport or long-distance train station pickups, the ride is considered a no-show when the client or passenger does not appear without prior cancellation within 60 minutes after the agreed pickup time, accounting for flight and train delays or earlier arrivals that result in a rescheduling of the original pickup time. In this scenario, the full ride fare is payable, with no additional charges for waiting time.

No-Show — Hourly Bookings

A ride is considered a no-show if the client or passenger fails to appear without prior cancellation once the booked hours have elapsed beyond the agreed pickup time at the specified pickup location. In the situation of a no-show, the entire ride fare must be settled.

For airport or long-distance train station pickups, the ride is classified as a no-show if the client or passenger does not appear without prior cancellation after the booked hours have expired beyond the agreed pickup time, accounting for flight and train delays or earlier arrivals. In this situation, the full ride fare is payable.

Ride Cancellation

Cancellations for rides within the five boroughs of NYC and out-of-town transfers must be made at least 24 hours prior to the scheduled pickup time to avoid charges. Cancellations made less than 24 hours in advance will be subject to the full fare. Cancellations can be made through our website or by calling our office.

For hourly bookings, cancellation is free of charge when there are more than 24 hours remaining before the agreed pickup time. If there are 24 hours or less remaining, the entire price must be settled. Cancellation requests can exclusively be processed through the cancellation feature within the website when clients log in to their profile and call our office.

Delays

In exceptional circumstances, such as air traffic controller strikes or severe weather conditions, compensation can only be provided to a limited extent. This means that clients may need to accept longer waiting periods or last-minute cancellations.

Vehicle Class and Model Upgrades

Clients have the flexibility to select from various vehicle classes for their ride request. The vehicle images displayed on the Elegant Chauffeur website are provided for illustrative purposes only. They do not guarantee access to a specific vehicle model within the chosen vehicle category, and regional variations may occur.

Depending on availability, the possibility of upgrading from a lower vehicle class to a higher category at no additional cost to the client is subject to availability.

Available vehicle classes include:

  • Sedan
  • Premium Sedan
  • SUV
  • Sprinter
  • Motor Coach
  • Mini Bus

Transport Safety and Luggage

The price stated in the booking confirmation includes the specified number of luggage pieces as indicated on the booking form. Additional or oversized luggage and the transportation of animals not mentioned in the booking comments may result in corresponding surcharges.

Elegant Chauffeur retains the right to decline the carriage of luggage and/or animals not previously agreed upon. This also pertains to animals not contained within an appropriate, securely closed transport container.

The necessity for child safety seats should be communicated by the client through additional comments, specifying the number and ages of the children to be transported, along with the required type of seating.

Ride Options and Service Adjustments

Our clients have the flexibility to select between transfer rides and hourly bookings for their ride requests. If the actual ride request requires more effort than the initial request in line with the client's specific preferences, additional effort may incur extra costs.

In the case of transfer services, the quoted price covers the journey from the starting point to the destination address. An extra fee, as per the current pricing structure, is applicable for each stopover along the direct route.

For hourly bookings, the trip must conclude within the municipal area of the pickup location, and it invariably commences at the confirmed pick-up time set during the booking process.

Passenger Conduct

Throughout the entire journey, all passengers must adhere to the regulations outlined in the relevant Road Traffic Act, particularly those concerning seat belt usage. Clients are expected to comply with any instructions provided by the chauffeur, who is responsible for ensuring a safe journey. Passengers are not allowed to open doors while the vehicle is in motion, throw objects from the vehicle, or protrude body parts from the vehicle.

Smoking is strictly prohibited within the passenger area of the vehicle. Clients or guests who disregard this policy are liable not only for the cost of vehicle cleaning but also for compensating any business losses incurred due to vehicle downtime.

While the consumption of food is discouraged, alcoholic beverages may only be consumed in the car with prior consent.

Damages

Elegant Chauffeur will charge you the cost of cleaning the vehicle as a result of you or your authorized party causing damage or getting sick in the vehicle. You also agree and acknowledge to pay all related fees to return the vehicle to its normal working condition.

If the vehicle is put out of commission due to damages resulting from your party, you will be responsible for compensating Elegant Chauffeur for lost revenue until the vehicle is returned to service.

Credit Card Transactions

We take authorization for the full amount on the card to guarantee funds availability 72 hours before the scheduled ride. It may show as "Pending" or "Posted" in your credit card account. The authorization amount may be higher than the expected charges in the event you decide to make additional stops or change your destination. We will finalize the charges on your card after the trip has been completed. All receipts are sent by email.

We have a secure 128-bit SSL encrypted payment system. By submitting payment details you consent to the detection and storage of your IP address to help guard against credit card fraud.

Disputes

For corporate clients with established corporate accounts, all charges of the invoice will be considered correct and due upon receipt unless we receive an objection within 10 days from the invoice date. Copies of the vouchers under dispute should be submitted to us and the disputed charges or items should be indicated. All disputes initiated after the allowed time frame period will be considered final and non-refundable.

For individual accounts and personal profiles, all charges applied to the customer's credit card will be considered correct unless we receive an objection within 15 days from the charge date in writing. All disputes initiated after the allowed time frame period will be considered final and non-refundable.

Collection Fees

You agree to pay all legal counseling fees, litigation fees, legal fees, costs, accounting fees, expenses, and disbursements for all actions taken before, during, and after the initiation of legal proceedings to collect payments due in cases of non-payment.

Rates Changes

Elegant Chauffeur can change the rates and any of the services, charges, costs, fees, and expenses at any time without prior notice.

Itemized Invoices

For corporate clients with established corporate accounts, itemized invoices will be sent regularly as "Due upon receipt" at the end of each month. Individual accounts, personal profiles, and itemized invoices are sent only when requested.

Point to Point Fare

Point-to-point service is calculated based on mileage and zones. This service is not for a set period, just the time needed to travel from point A to point B. If you need a vehicle for a set number of hours, please reserve the hourly service.

Corporate accounts that meet the minimum usage requirements might be eligible for special discounts depending on volume. Check with an account sales representative for special pricing.

Hourly Rates

Packages of vehicles are charged hourly. Certain hourly minimums and zone restrictions apply. Hourly services have a 3-hour minimum outside Manhattan. Weekends and holidays may have a longer minimum hourly requirement — please call or email us to confirm.

The hourly charge is calculated based on the time the vehicle is scheduled to pick up in the NYC 5 boroughs to when the vehicle drops off in the 5 boroughs. If your pickup or drop-off destination is outside of New York City you may incur a travel time charge.

Nationwide trips: the clock will begin and end when the vehicle leaves/returns to the garage. Prices vary by date and vehicle availability. For seasonal events such as graduations and weddings, reserve early.

Waiting Time

Elegant Chauffeur provides 30 minutes for domestic flights and a grace period for international flights based on the reported flight arrival time for airport pickups. A 15-minute grace period is granted for all other pick-ups. After the grace period ends, charges will accrue from the original pick-up time in 1-minute increments.

Flight and transport monitoring policy:

  • Commercial domestic and international flights: monitored one hour before driver dispatch; billing starts after the grace period from the official touchdown time
  • Private flights: we are unable to monitor private flights — please notify us of any delays or itinerary changes
  • Train station pickups: train schedules cannot be monitored accurately, therefore billing begins at the scheduled pick-up time

Baby Seats

Elegant Chauffeur recommends that parents provide their own baby seats; however, we can provide one for an additional charge. For exact pricing, please call our office at (877) 435-2445 or email us at Info@theelegantchauffeurs.com.

Stops

Price per stop varies based on distance and location — please call us to request pricing. Courtesy stops, such as briefly leaving the vehicle to pick up coffee, a newspaper, or to mail a letter, do not incur extra charges. However, if longer stops or multiple stops are made you will be billed stop charges. Picking up additional passengers will also incur stop charges.

Tolls

All round trip tolls are billed to the customer depending on the route chosen. Elegant Chauffeur will charge for all round-trip tolls to and from the designated destination. Elegant Chauffeur only collects the tolls — we do not charge them.

Meet & Greet

Meet and Greet Airport Service is offered at an additional charge. Parking and waiting time charges (if incurred) will be billed to your account or credit card. The driver will be instructed to meet the passenger by the baggage claim or the exit of customs with a sign bearing their last name, then escort the passenger to the designated vehicle location while assisting with luggage.

This package includes 60 minutes complimentary free wait for domestic flights and 60 minutes complimentary free wait for international flights from the arrival time.

Luggage

Elegant Chauffeur disclaims responsibility for any luggage damage or the items within the luggage. It is essential to adhere to guest and luggage capacity limits for safety. In cases of uncertainty, opting for a higher vehicle class is recommended, as chauffeurs may decline service when these limits are exceeded.

Parking

All parking fees and other airport regulatory fees are additional. We do not charge them — these fees go directly to the airport parking lots.

Holiday Surcharges

A holiday and severe weather surcharge may be applied to trips occurring on national or religious holidays or days with inclement weather.

Service Error

In the event of a vehicle breakdown or service error, Elegant Chauffeur will make every attempt to provide a replacement vehicle (possibly through a third-party affiliate) that is equivalent to the original reservation. If a replacement vehicle cannot be provided in a timely manner, Elegant Chauffeur will refund the full amount paid for the affected service.

Service Termination

Elegant Chauffeur reserves the right to terminate service without prior notice in cases where the client's behavior poses a risk to the driver, vehicle, or other passengers. This includes but is not limited to abusive language, violent behavior, or illegal activities.

Privacy and Data Protection

Elegant Chauffeur respects your privacy and is committed to protecting your personal data. Please refer to our Privacy Policy for details on how we collect, use, and safeguard your information.

Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which Elegant Chauffeur operates. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
